Please read these Terms of Service (“Terms”, “Agreement”) carefully before using the website or booking any emergency vehicle recovery, towing, or roadside assistance services provided by Godiva Recovery (“we”, “us”, “our”).
By requesting our assistance, you explicitly agree to be bound by these Terms. If you do not agree, we cannot dispatch a recovery vehicle to assist you.

1. Definitions and Dispatch of Services

  • Services: Includes 24/7 roadside rescue, accident recovery, vehicle transport, battery jump-starts, wheel changes, and wrong fuel extraction.
  • The Customer: The individual requesting assistance, or the owner/driver of the vehicle at the time of service.
  • Dispatch Policy: Dispatch times given by our dispatchers (e.g., “30–45 minutes”) are estimates only. While we strive for speed, we accept zero liability for delays caused by traffic congestion, weather conditions, road closures, or prior emergency incidents.

2. Fees, Cancellations, and No-Shows

  • Call-Out Fees: Once a recovery vehicle has been dispatched from our depot, a non-refundable Call-Out Fee applies immediately.
  • Cancellation Policy: If you cancel the service after our driver has departed our base, you are liable for the full Call-Out Fee to cover time, fuel, and lost business.
  • No-Show / Cancelled on Arrival: If our driver arrives at the scene and you have abandoned the vehicle, sorted the issue via another company without telling us, or provided an incorrect location, you will be billed for the full estimated cost of the job.

3. Payment Terms and Right of Lien

  • Immediate Payment: Payment is due strictly upon completion of the service on-site, or prior to unloading the vehicle at its final destination, unless a credit account has been formally pre-approved.
  • Right of Lien (Holding the Vehicle): In accordance with UK law, Godiva Recovery reserves a contractual right of lien over any vehicle we transport. If you fail or refuse to pay for services rendered, we reserve the right to withhold possession of your vehicle and store it at a secure facility at your expense until the balance is cleared in full.

4. Customer Responsibilities & Vehicle Condition

  • Accurate Information: You must provide accurate information regarding your location, vehicle condition, and key status (e.g., if keys are missing, wheels are locked, or the vehicle cannot roll). Failure to declare these facts may require special equipment, resulting in additional charges.
  • Legality: You warrant that you are the legal owner of the vehicle or have explicit permission from the owner to move it. The vehicle must not contain illegal goods or hazardous contraband.

5. Limitation of Liability & Vehicle Damage Claims

  • Existing Faults: Godiva Recovery accepts absolutely no liability for mechanical or electrical faults that aggravate or worsen during standard loading, unloading, or transit as a result of your vehicle’s pre-existing breakdown condition or accident damage.
  • Component Failure: We are not liable for the breakage of old, corroded, or structurally compromised vehicle parts (e.g., rusted towing eyes, snapped cables, broken suspension components) during standard recovery procedures.
  • Claims Window: In the highly unlikely event that our equipment or driver causes fresh, verifiable damage to your vehicle, you must report it to our driver on-scene before signing the job completion sheet. Godiva Recovery accepts no liability for claims submitted after our driver has left the drop-off location.

6. Roadside Safety Directive

For safety reasons, customers must follow all instructions given by our recovery drivers. If you act aggressively, refuse to stand in a safe designated area, or put our recovery specialists at physical risk on a live highway, we reserve the right to immediately terminate the service without a refund.

7. Governing Law

This Agreement and any dispute or claim arising out of it shall be governed by and construed in accordance with the laws of England and Wales, and subject to the exclusive jurisdiction of the UK courts.
